Parking Ticket Recieved on my property


What is the name of your state? NY

I live in staten island NY, I recently recieved a Notice of Outstanding Parking Violation letter stating that I had recieved a ticket(which I never got) for expired inspection sticker. The car that has recieved this so called ticket, was parked in my driveway with a valid inspection sticker. I never drive it. The sticker expires on 04/04/07. According to the notice the ticket was given on my block at 5:45AM, and the docket# is 0000000000. This all seems very strnge to me and I want to know if it is legal to recieve a ticket in your driveway on your private property....also I live in a private community. If it is not legal can someone tell where I can see written proof of this so I can write in my hearing by mail letter. Thanks

Maybe. The exact poisition of the driveway and vehicle relative to the right of way would matter.

Being in a private community does not matter.

That said, your inspection was current at the time of the ticket? Right. You didn't need to inspect it after recieving the ticket.. So the ticket is in error anyway.

The informatio on how to to respond or contest is on the ticket. I hope you can correct this error by mail, however I have never seen a ticket in NY (anywhere) that could be contested other than in person during business hours....

Yes the Inspection was valid, the car was parked in my driveway...not across it...as in the path leading to my garage. I was under the assumption that you could not get parking tickets while parked on your own property. Thanks for the reply though

If you saved the white paper receipt (with the emissions testing results) from your inspection, copy it and mail it in with your Not Guilty plea. (That is assuming that the inspection was actually performed prior to the ticket being written).

The docket number is irrelevant - there is a number written along the side of the ticket vertically which is what you need to enter to contest the ticket online. (You stand a much, much, much better chance of winning if you go in person however).

If it is a legal requirement to have a current inspection for your vehicle to have a registration or anything else, it would make no difference if the car were on the moon. The state requires you to have that sticker to have the reg or whatever else and they didn't see it.

Now go fight city hall.

Curious question though. If this sticker expires 4/4/07 and this is just 1 month later and presuming the inspection is valid for 1 year it would mean you had it inspected this past April 4, when did you get the ticket?

It seems very quick to get a notice from the city already. I would presume you had some time to answer the ticket (10 days maybe). This would mean they sent out the notice with you being less than 3 weeks overdue. Are they really this efficient in New York?

Are you kidding? Sitting in front of me is a parking ticket (about the 20th of 2006) conveniently written at 8:36 for an 8:30 sign (they know 5 minutes or less can be dismissed due to differing watches). I've also received lapsed inspection tickets the day after it expired. I even know plenty of people who used to get them on the last day it was still in effect, (until they trained the meter maids that the inspections expired at mignight, not before).

There's big money to be made in the ticket business.

Presumably, although I pesonally seem to be financing a good portion of the city budget with all the fines I pay. (Never actually got paid for handling a ticket; always been a favor to friends).

I was thinking more about the time to recognize the failure to pay and subsequent notification to the OP. One month seems very fast from write to late notice. Maybe it;s just that I'm from a small town that doesn't notify you at all until you get a traffic stop.

As far as the 30 second guarantee where we guarantee you a ticket within 30 seconds of expiration of anything involving you car or ,,,,well there is no or, you just get the ticket,,,,,,maybe big brother is closer than you realize.

Do you remember that other post where the guy got a ticket for parkong in the handicaap spot? He claimed the ticket officer was hiding in the bushes, waiting for violators.
Well, have you looked in your bushes lately??
