What is the name of your state (only U.S. law)? New YorkWhat is the name of your state (only U.S. law)? My granddaughter was ticketed for not wearing a seatbelt when she was a passenger in a car driven by her boyfriend. She was in fact wearing a seat belt which the officer acknowledged but told her it was incorrectly worn and he ticketed her anyway. What recorse does she have?

If she wasn't wearing the seat belt correctly, the ticket in valid.
OT: A guy in Kansas made a seatbelt belt (as in around his waist) and took it to Kansas SC and lost.

As pointed out the belt needs to be properly worn. If this ticket was issued in a jurisdiction where plea bargaining is permitted there really isn't a lower charge that this can be reduced to.

This is a minor infraction which carries no points. I personally wouldn't waste too much time and effort fighting it. She should learn how to safely and properly wear her seat belt (for her own safety) and go ahead and pay the fine.
