set aside suspensions


What is the name of your state (only U.S. law)? California

I have an employee who got a ticket for no current registration. He swears that it was just an error, he had paid the reg fees on time but something had happened with the smog cert. Unfortunately, he failed to ever take car of it. well his incomplete reg ticket became a FTA and then proceeded to become a threatened licence suspension as of last month. we pulled his DMV record as a normal course of action and discovered all of this.

He swears he never had any clue that he had a FTA and then a possibly suspended license.( states that his license was never suspended) I call BS, and regardless, even if he never opened his mail, this does not absolve him of his personal responsibility to have gotten the reg issue cleared up in the first place.

anyway I asked him to prove to me that his license was valid, he drove to the DMV and had them pull a information request. on that request, it shows the original ticket, the FTA dates, the suspension dates, and then indicates that the suspension was "set aside" on the date the suspension was to take affect.

on a side note, this in the Third FTA and suspension or threaten suspension in the last 6 years, so this guy is no dummy on this issue. One other suspension was set aside and the other was "action terminated a few days after the suspension took affect.


He stated that he now has to pay an almost $900 fine, yet the suspension was "set aside"?

how come it does not show up on the current DMV report that is sent to us in the mail, yet it shows up on the information request he got at the DMV?

also, does he not have to actually actively "do something" to get the suspension set aside? have a hearing, pay fines etc.? so his claim that he knew nothing about anything is bogus right?
