Statute Of Limitations On Parking Ticket


What is the name of your state? NEVADA

I RECEIVED A PARKING TICKET FOR PARKING NEXT TO A HANDICAPPED PARKING SPACE. MY TIRES WERE ON THE WHITE LINES, WHICH WERE SUPPOSED TO BE BLUE IF IT WAS A HANDICAP SPOT, AND I RECEIVED A $250 TICKET FOR THIS VIOLATION.
IN NEVADA YOU HAVE THE OPTION OF PAYING THE TICKET OR AGREEING TO A FORMAL CIVIL SUIT BEFORE A HEARING OFFICER. I ELECTED TO GO TO THE HEARING MASTER SINCE THE PARKING SPACE WASNT CLEARLY MARKED.
MY QUESTION IS: I RECEIVED THE TICKET OVER A YEAR AND A HALF AGO AND NEVADA HAS A STATUTE OF LIMITATIONS ON ALL MISDEMEANORS OF 1 YEAR FROM THE DATE OF OFFENSE. I SPOKE WITH THE CITY ATTORNEY WHO HANDLES THESE CASES AND HE TOLD ME THAT IT WAS 2 YEARS. I KNOW FOR A FACT THAT THE STATUTE OF LIMITATIONS IS 1 YEAR. YOU CAN LOOK IT UP IN THE NEVADA REVISED STATUTES. THE HEARING STILL ISNT SCHEDULED AND THE CITY ATTORNEY SAID IT COULD BE A FEW MORE MONTHS. DO THE STATUTE OF LIMITATIONS BEGIN WHEN THE VIOLATION IS NOTICED OR WHEN YOU RECEIVE THE TICKET. I AM NOT ALSO REQUIRED TO HAVE A RIGHT TO A SPEEDY TRIAL? I AM PRETTY SURE THAT IS IN THE CONSTITUTION.
DO I HAVE A CASE TO HAVE THIS THROWN OUT?

IF YOU THINK YOU ARE THE EXPERT YOU SHOULD PROBABLY READ THE FOLLOWING PARAGRAPHS INCLUDING THE LAST SENTENCE. THERE WAS NO SIGN POSTED NEXT TO THE HANDICAPPED SPOT.

11.52.030 Curb marking color code.

The parking of vehicles is prohibited or restricted in certain zones as set forth in this Section. The location of such zones shall be established by posting appropriate signage or other durable markings, by painting curbs or the edges of road surfaces in accordance with the colors listed below, or by a combination thereof:
F) Blue indicates parking for handicapped persons (driver or passenger) for a period not to exceed four hours, whether or not the time limit is posted, but only regarding:
(1) A handicap space which is properly posted pursuant to LVMC 11.52.135; and
(2) A vehicle which displays a valid handicapped permit or license plate

11.52.135 Handicapped parking.


(A) Any parking space designated for the handicapped must be indicated by a sign:
(1) Bearing the international symbol of access with or without the words “Parking,” “Handicapped Parking,” “Handicapped Parking Only,” “or “Reserved for the Handicapped,” or any other word or combination of words indicating that the space is designated for the handicapped;
(2) Stating “Minimum fine of two hundred fifty dollars for use by others” or equivalent words; and
(3) The bottom of which must not be less than four feet above the ground.
(B) In addition to the requirements of Subsection (A), a parking space designated for the handicapped which:
(1) Is designed for the exclusive use of a vehicle with a side-loading wheelchair lift; and
(2) Is located in a parking lot with sixty or more parking spaces, → must be indicated by a sign using a combination of words to state that the space is for the exclusive use of a vehicle with a side-loading wheelchair lift.
(C) If a parking space is designed for the use of a vehicle with a side-loading wheelchair lift, the space which is immediately adjacent and intended for use in the loading and unloading of a wheelchair into or out of such a vehicle must be indicated by a sign:
(1) Stating “No Parking” or similar words which indicate that parking in such a space is prohibited;

As a consumer, I would agree that it was inappropriate to be given a handicap citation if you were parked on a white line. Did you take photos?

I have no idea of statute of limitations limits; but somehow I recall that this ends once the court processing begins.

It sucks when law-abiding citizens are treated this way. Are you from Nevada? Although it is a civil legal issue, I wish the public could obtain their civil rights back when dealing with government infringing on the public. It isn't Joe Six pack filing a complaint, it is a government entity!

Speak to a lawyer? If I were you, I would prefer to support and give the money to an attorney than to the city for this type of case. But make sure the attorney is certain of a win.

Since You Are The Expert Curt, Although I Am Not Sure About What. It Certainly Isnt The Law Or Reading.

Hey Mikey, if you think you have all the answers, why bother posting here? Certainly, nobody here knows anything about the law, and you obviously know everything, so why are you asking for advice? Really? Just go away now, please.

I think you are confused over the ideological scale, so let me help you out: republicans likes to have people screwed over. Hippies such as myself prefer peace on earth. Also, despite what party Hillary is from, hippies do not support her.

Oh, and very witty comment about my mother. I am glad you are able to express yourself with such intelligence, and am sure you'll be able to use that, as well as your impressive grammar, to lead a very successful life.
