Stopped in Handicapped Parking


In NJ, I stopped the car in a handicapped parking space, and left a licensed driver with the car, so it could be moved if required. The posted penalty for 1st offense of parking in a handicapped space is $100.00. The actual cost is $274.00. Why was the other driver not allowed to move the car before the ticket was issued, and why is it legal for the fee to be greater than the posted amount. Can I fight this and win?

The other driver is inmaterial. You parked in a handicapped space. There is no excuse and no "well, if you move it we won't ticket you" clause in the law.

Youre lucky you didn't get your legs clipped to the point of needing a handicapped placard.

BTW - the fine is just the start. There are also court fees, etc that get tacked on top of the "base" ticket price

Fines are only the beginning sometimes. While there may be a enumerated fine, there can also be administrative costs added to the fine for total greater than just the fine. They aslo like to toss in fees for things like "violent offfenders fund" and other things that seem to be totally unrelated.

It does seem as it would that it would in effect all be considered a fine but they get away with it in my state.
