Ticket for mutilated registration


What is the name of your state (only U.S. law)? NY
I received a ticket for aregistration that had torn. Both halves were in the window clearly visible, legible in full view. What is my defense, do I have any ground to stand on. It ripped today and I had not been home yet from work to order a new registration.
Please advise me.

If the law requires that you not have a torn registration, and you had a torn registration, then you are obviously guilty of the offense and have absolutely no legal standing to defend yourself.

That being said, if you show up to court with proof that you are now in compliance of the law, you may indeed see some sort of leniency from the court, which may be in the form of a reduction in fees (rather likely) or even an outright dismissal (not very likely at all, but not completely unheard of).

How do I find out if it is against the law in the state of NY to have a torn registration?

Also, an officer is not usually going to waste his time by writing a ticket for a law that doesn't exist.

provided that any summons issued to the operator for violation of this
section is turned over to the lessor. A violation of this subdivision
shall be punishable by a fine of not less than fifty nor more than one
hundred dollars for a first offense, and by a fine of not less than
fifty nor more than two hundred dollars or by imprisonment for not more
than fifteen days, or by both such fine and imprisonment, for each
subsequent offense; provided however, that if the vehicle bears a
certificate or certificates of inspection which was or were valid within
the last sixty days, such violation shall be punishable by a fine of not
less than twenty-five nor more than fifty dollars.

Whoops. Not that the OP is coming back, but I cited the inspection rule. Registration is at 4-08(j)(3).
