Towed HC during No Parking Hours - CA


What is the name of your state?What is the name of your state? CA
As the property owner of a small shopping center, we had a car towed that was parking in a regular parking space (not a HC marked space), although the car did display a HC placard. The entrance to the center is clearly marked that it is "Customer Parking Only" and each HC space has an additional sign for handicapped towing information. The owner of the car was not a customer and was not parked in the HC space. We would not have towed the car if it was parked in the HC space.

Did we legally tow this car since it was in a regular space, or does the HC placard allow cars to park whenever and wherever they want? This doesn't seem fair, but we are being served with a law suit and I wanted to get some additional advice. Thanks.

The handicap parking credentials mean nothing. Your "customer only parking" limitation should apply to all those that use the parking lot. If the driver of the vehicle was not a customer, your sign is all the defense you require. I would suggest a consultation with a local attorney just to make sure there are no local ordinances that could be used against you. If there are any, they should be listed on the lawsuit paperwork.
