Towed in WA stateWhat is the name of your state?What is the name of your state? Washington I was parked infront of a closed gate on the side of a empty building. There were two signs behind the gate: "No Tresspassing" and "10mph" (pertaining to the little road behind the gate. There was also a "For Sale" sign with the realestate agency's name and number. My car was towed. When i picked it up, it turns out a security officer for the building signed to have the car towed. He told the tow truck driver that he watched my car pull up, and when i got out he informed me that i could not park in the space -- doing so would result in the car being towed. He said that i just locked my car and walked away. Simply stated -- this is not true. There was other cars parked there when i parked there, and no security officer was in sight. After i payed $$$ to get my car back, i went back and took pictures of the spot and lack of signage. I want to fight this, but what are my chances in court? I read RCW 45.55.070 and RCW 46.55.085, but still unsure. The place i parked by was an empty factory -- so i'm guessing it was non-residential private property? How should i proceed? |

| Just because other cars parked there doesn't mean that it was legal to park there. All the other cars could have left by the time the security guard showed up. Was the closed gate you parked infront of for cars to drive through? If it was I don't think you have a chance to fight this. |

| The road behind it was not ever used for public to drive through, it is one of several roads that go around the empty building. I know just because several other cars were there it doesn't make it a parking place. I am just wondering if it was legal to tow it? If i was not obstructing right of way, wouldn't it count as being on non-residental private property, therefore not legal to move it? If it WAS obstructing the right of way, wouldn't it be a police issue to move it? If so, then my car should have been tagged and left for 24 hours before towing? As far as it being "unsafe" to leave it there if it was a right-of-way, it was a wide opening and i was at the very far end with lots of room for vehicles (even semi's) to drive by if the gate were open (opened to the inside). Once again though, it wasn't a public road. The other thing I was wondering about was the security guard saying he told me I couldn't park there, but that I did anyways. Did him having "talked" to me make it more legal for him to have my vehicle towed? I very well may be in the wrong still, but these were more along the lines of the questions I had. |
