unfair selective enforcement


What is the name of your state? Indiana

I was pulled over for seat belt inspection and fined. While I was fined two cars sailed past the officers with heavily tinted windows and the other officer let the male driver he stopped go. I questioned him about it and he said he had a shoulder surgery and was not legally required to wear the belt. I saw the man immediately put the belt on as soon as the officer confronted him. I overheard the conversation and the other driver stated that he was just going to turn in up the street because he lived right around the corner. Something is rotten in Denmark as the saying goes.

It might be "unfair", but it's legal.

Officers don't have to cite everyone they stop, and they don't have to drop what they are doing to chase the next infraction that passes by. They are generally granted a great deal of discretion. You may not like it, but it does nothing in your defense.

If you were hoping to use that as a defense, it won't work.

Question

NY State

I am experiencing the same sort of problem. I was parked at a no-parking stand ( I did not see the sign). There was another vehicle behind me with the driver in it, of course; and another vehicle just pulled in front of me. Do you know the traffic agent did not give those two vehicles a ticket?
Should it matter if the driver or passengers are in the car or not? I mean if they are parked at a No Parking zone, shouldn't they have been ticketed, too?

They could be, but it's still not a defense.

And if the citing officer was a parking enforcement officer, it could be the agency policy (or the law) that they are not to give cites to occupied vehicles. For safety reasons, I can see that giving citations to occupied vehicles could be dangerous for a non-police officer ... people tend to get miffed when they get a parking cite.
