Web based business procedure patent


What is the name of your state (only U.S. law)? Outside USA, in the UK

Hi

Is there a way to patent business procedures for an online business idea worldwide? What I mean is that World Wide Web is a global thing and if I file patent for business procedures in the US then nothing is stopping any one in Europe (even though in the UK its not an issue: I've heard that business procedures can't be patented in the UK for instance), China or Middle East from doing the same thing.

Is there any global organisation which looks after such kind of rights or claims and actually enforces rules and regulations?

Can some one use business procedures in an online business which are part of a patent in one country (e.g US) and not in another (e.g UK)?

There are no international patents, with the limited exception of European patents (patents obtained through the European Patent Office), which have some enforceability within the entire EU. Other than that example, all patents are strictly national in scope. A U.S. patent, for example, can generally only be enforced in U.S. courts against an infringer in the U.S.

But the European patent isn't going to help you, since, as you correctly noted, business method patents are not available in the EU (and may not be available that much longer in the U.S. either...).

It is legal for someone in country A to do something in country A that would be infringing a patent if the same thing were done in country B.
