Prior to my Uncle passing away, all his assets and property were signed over to one of our Cousins "Executrix" over a seven year period. All savings and investment accounts were " a joint account with survivorship between cousin and Uncle". Upon his passing myself and other cousins were named benefeciaries in his will. We each received $250.00 from an insurance policy that was divided amongst the cousins and told that this was the only probate asset and asked to sign a receipt acknowledging the final distribution. We have not cashed the check or signed the receipt to date. We know that upon our Uncle's death our Cousin "Executrix" paid the state of Ohio $10,312.97 in Estate taxes. That amount puts the total value of His/her assets at over $600,000.00. We believe that our Uncle was not capable of making these type of decisions and that our cousin the "Executrix" pressured him and wrongfully coerced him into signing everything over in a joint account with survivorship. We also have witnesses who will testify to this. We have done a lot of investigating of this matter on our own and also have retained a Probate Attorney who we have paid appoximately $2500.00 so far. His services to date have included writing a letter requesting a copy of financials for the last 10 years. However, he is quite undecisive as to how to proceed and which course of action to take. Either "Probate" or "tortious inference with inheritance"? He has been dwelling on this for over 5 weeks. Now he says we need to come up with $15,000.00 for him to move forward on this but still has not given us a plan. Do we have a case???????? Is it time to look for a new Attorney???????? If so can you recommend one in the Cleveland, Ohio area??????? Or is this common behaviour for an Attorney in this type of case????????????
