Any recousre for holding back K-1 and info?

My uncle has been handling my grandfathers estate and although I got a check back in 11/04, he has refused to give me or my attorney any financial accounting on the Trust from which it came.
Yesterday I received a Fiduciary 1041 K-1 (dated 6/30/05) showing I have taxable income for 2004. I have since found out the estate got an extension back in April giving them until 7/15/05 to file with the IRS which they apparently did on 6/30/05 - but my uncle held onto my K-1 until this week.
In hindsight, he could have told me back in April when I filed my 1040 that there would be a K-1 coming so I could file an extension or at lease make a withholding payment.
Now I have to file an amended return and pay penalties and interest -
all because he has refused to give me any accounting info what-so-ever which we have been requesting for over a year now.
Do I have any recourse against him, or can I submit my amended return with an explanantion to the IRS (and copies of our requests for accounting info) in hopes I won't be penalized?
Should I tell the IRS about his refusal to provide info and sending my K-1 so late?

You're right, my apologies... it's Florida.

No, the distribution I received is more than what is on the K-1. I can only assume my uncle sold off some of the mutual funds and therefore the K-1 is showing some dividends, short and long term gains.
