What is the name of your state? Maryland
If debt of deceased is more than what estate is worth do children or spouse of the deceased assume this debt? :confused:

Nobody does. The estate pays the debts of the deceased. If there is not enough in the estate, the creditors are out of luck.

My response:

. . . unless one of the survivors is a signatory to the contract. Then the debt falls on that person's shoulders.
