Beneficiary of Ins and PR


What is the name of your state (only U.S. law)? DC

As the beneficiary my mother's ins policy and personal property and PR for her estate, I've been using the ins money to pay her debts and also gave my sister some of this money. The money has run out and there is still the property tax and homeowners insurance that will have to be paid out-of-pocket until the house is sold.

There was also a clause in the will that instructed me to put her personal property in storage, this to will have be paid out-of-pocket.

I've been keeping track of the expenses and wanted to know if I could get the money used from the policy and my out-of-pocket expenses from the proceeds on the sale of her house.

If you were the designated beneficiary on the life insurance policy, you were under no obligation to use the funds for estate expenses. But what is done is done. (And it was nice of you to do it.)

If the will left her personal property to you, I don't understand why it has to go into storage. (????)

I would not get into any mental accounting about where the money came from - life insurance proceeds or otherwise. The money came from you. You made a loan to the estate to pay estate expenses. You can be reimbursed when the estate has sufficient funds to do so. If you aren't doing so already, let your sister and other beneficiaries know that you are doing this so that they don't feel that they are getting shafted when the time comes to make final distributions from the estate.

(I notice that you mentioned giving some of the insurance proceeds to your sister. Just to avoid misunderstanding... That was a gift from you to her and not something that you can be reimbursed for from the estate.)

Sorry, is wasn't storage, it was packing, shipping and shipping insurance. And, to that end, I figure this has something to do with giving these items to charity and such.

As for the expenses, I figured as much about the money to my sister, no problem, but wanted to be sure about the other expenses.
