Caretaker forged documents

A friends father passed away and the father had a live i caretaker. The father passed away and did not even notify my friend, who is the only child. When he found out he went to the house and this lady had her family living there and she would not even give him a copy of the will. He went to the mortuary and got a copy of the death certificate and she put on there, "daughter" to his father. Now she tells him all his dads stuff is gone or lossed, plus his mothers things who passed on a while back. What can he do?

You didn't mention what state this is in.

Did the father have any assets (did he own the home, or have a bank account)? If so, then your friend can open up probate at the county courthouse without having the will.

Your friend should first have a consultation with a probate attorney to help him determine whether he should proceed with probate.

And your friend can also get the caretaker in trouble for making a false statement on the death certificate. Maybe your friend can use the threat of filing charges for the false statement on the document by using the threat as leverage to see if he and the attorney can get the caretaker to first return some or all of the assets, and after he has filed for probate he can also start the process of getting her and her family evicted. What a mess!
