death of family member with no will


OREGONWhat is the name of your state?

My sister-in-law died unexpectedly last week at the age of 42. The houses are in her name soley. Is there ever insurance written into mortgages that upon her death the house is paid for in full or partial? Do all of her possessions now transfer to her husband (my brother) or her blood next of kin (my neice)? How do we get the houses moved into his name, etc?

Question about insurance.


Sorry to hear about your loss. It sounds like a shocker. It is sad when people have to go so young.

I do believe there is mortgage insurance that one can purchase that upon death the mortgage will be paid off. I would think her husband would know if they had something like that.

I am also pretty sure that upon death, her assets transfer to the husband. There probably is some paperwork that needs to be filled out to do all the transfers and some small costs associated with them.

You can probably visit an attorney pretty cheaply and he/she can give you an overview of what he would need to do.

Your sister's assets will be divided by Oregon's Intestate Succession laws. They can be found [URL=http://www.oregonlawyer.com/ors/Chapter_Details.cfm?Chapter=112]HERE[/URL].

INTESTATE SUCCESSION
ORS 112.035
Share of surviving spouse if decedent leaves no issue If the decedent leaves a surviving spouse and no issue, the surviving spouse shall have all of the net intestate estate.

Issues, for purposes of probate, means children.

As to Mortgage insurance, that is something that the mortgage holder can tell you.
