    Does a will avoid probate?

    Does a will (in Florida) avoid probate or is that a constant regardless?

    No. Probate is the legal process for carrying out the decedent's wishes as expressed in the will.

    Or the state's wishes if there is no will.
    There are two rules for success:

    (1) Never tell everything you know.

    No, but having a will could reduce the cost of probate. The regular probate process can be minimized for some small estates that do not exceed a certain value.
