What is the name of your state? New York
It is my understanding that the executor of an estate takes a percentage share of the estate as their fee. Are life insurance proceeds considered part of the estate when determining the executor's share? Can you direct me to the specific section of the New York Probate Code which answers this question?

If the life insurance proceeds were designated to a particular beneficiary, then they should NOT be included as part of the estate on which to base the executor fee, and this is common knowledge in law--any attorney will tell you that. Is this attorney trying to tell you differently? Tell him to go pound sand, because you know differently, and you should be asking HIM to show you where New York law allows that.
