What is the name of your state (only U.S. law)? california
My father died a couple weeks ago and was remarried for a few years. His widow has moved out of his house back into her own. They have no legal community property. He has left several vehicles, a small house a gun collection and I am told alot of debt. One of my younger siblings has been working with his wife and seems to be taking charge of everything but not cooperating with the other siblings (removing property from his home and claiming to be in charge but has not filed probate). Can she do this if no probate has been filed? I am prepared to file and name her as administrator just to keep her honest. Can I name someone other than myself as administrator in my petition? And will shje be forced to be accountable for all the information and property she is claiming to have taken care of?

You can't name someone else to be administrator. And, even if you try, she does not have to accept. If you want to keep her honest, apply to be administrator yourself.

Keep in mind that personal property is a bear. Once it is gone, try to prove that the deceased owned it and owned it at passing.
