My grandparents were both residents of New york but when my grandmother got dementia my aunt moved her and my grandfather to Chocowinity,North carolina. My grandmother was living in a nursing home while my grandfather was living with my aunt (his daughter). They had a will drawn up and they sold their house in 2003 (in New York). My grandmother died in late 2004. My grandfather died in May of 2006. We have yet to hear anything about the will. We hired a lawyer in the same city, state (North Carolina) to see what the story is. According to him, there wasn't anything filed, so he said he went ahead and filed as of this month (January 2007) on behalf of my father (who is the administrator of the will). His sister is the executor of the will. Well, she's been away for the last 8 weeks and now she came back and told my father that their father set up the will as kind of like a pension where he would get money every month for the rest of his life. Now, he doesn't have a copy of this will, (because she wont give him one) but when this will was written up it was done in new york where it stated that both parties would split everything 50/ 50. Does she has a right to change the will at all? Is it possible she talked my grandfather into changing the parameters of the will? ICan my father make any changes to the will to reeive what's owed to him in one lump sum?
This has been a nightmare from the very beginiing as my aunt and father don;t have a loving relationship and she likes to control the situation any way she can. Your help would be greatly appreciated. also, do we need to get a lawyer located in the town where this will is to be executed? (In Chocowinity,North carolina) We are in need of someone who will be a bit on the aggressive side and wont be afraid to deal with this woman. We really want to expedite this as soon as possible. I live in New york as does my mom and dad. Its already been 8 months! The lawyer we have now lacks the OOMPH we need to get the ball rolling, Does it matter that the will was drawn up in New York? even though they lived in new york all their lives and them moved to NC?
