It depends on the value of the assets subject to probate. If over $100k, then yes. If under 100k, there is a short form procedure for realty, and an affidavit procedure for personalty.

If you plan on doing a probate yourself, I suggest buying a "how to" book written specifically for California. The rules, procedures and forms are many, and not easy to discuss in this format.
