House Viewing By Appt.

What is the name of your state (only U.S. law)? DC

I am the PR for my mother estate. I'm selling the house while my sister is living there. She is there as security for the home. She has her own apartment. I'm showing the house by appointment and she only wants viewing on Sundays during 12-3. I've had agents to call wanting to view outside of her designated time. Do I have to keep to her schedule or can I let her know when I plan to bring let someone see the house. Also is there a rule on vacating the property, is giving her 30 days enough?

I don't know whether she would be considered a tenant under New York law and, if so, what notice she would be entitled to.

But, I would try to give her 24 hour notice and tell it's to bleepin' bad if she does not like it. Her "schedule" is nonsense.

So, she wishes to ELIMINATE all these people from the pool of potential buyers?
  • Football fans.
  • People who work on Sundays.
  • Religious Jews
  • People whose children are in Sunday afternoon sports or other extra curriculars.
  • Motivated Buyers who are looking during the week.

Great selling plan.

Yep, if I was a buyer, and only able to see it on Sunday afternoon..... I would be going right on by.

Can you show the rest of the house without showing her apartment? Are there other similar apartments?

Me too. I expect to be able to show or see a home during any reasonable time of day. One cannot presume that their schedule is the same as all potential buyer schedules. You can't sell it if you can't show it! And limiting buyers to a three hour window WEEKLY is outrageous.

Steve, I believe that the sis who resides in mom's home ALSO has her own apartment unrelated to this estate property, refered to as mom's HOUSE. The estate has no apartment.
