    How does court decide who should be apppointed personal representative ?

    What are the main factors the court considers when appointing a personal representative when someone dies intestate ?
    A brother died intestate and the closest relatives are 2 brothers, 2 sisters, 2 nieces ( from another deceased brother ) and a niece & nephew from yet another deceased brother .
    The two living brothers, one of the living sisters and 3 of the nieces and nephews would like to get probate started and would like to see one of the brothers or sisters be appointed, but one sister and one niece say they will agree to nothing.

    It sounds like the personal representative is in for a hard time. The first closest relative that files to be the personal representative is usually at the front of the line. Unless someone can show why they should not be appointed then the court will name them. My suggestion would be for the two brothers to file to be corepresentatives.

    If the estate is sizeable they should then hire an attorney to represent the estate.

    The porbate court can provide you with information on the laws of your state and many have classes on administering an estate.

    No one has filed but that will be our next step. It helps to know that if the two brothers file there is a good possibility they will be appointed.
