How to sell real estate left to heirs and not the estate?

North Carolina...

My grandmother died last year. I am executor. Personal property was left 50/50 to me and my brother. Will specifically stated that executor could sell and split money in case of dispute over personal property.

House/land was left specifically to the heirs (us), not the estate.
He is living in the house, and it is a travesty now...we have over 5000 dollars of fines from the city from his junk in the yard, old cars, etc. I am also personally responsible since I am one of the heirs.
He cannot buy me out, so that isn't an option.

I have not finalized the will, so I am still executor. Is there a way for me to sell the real estate, and just split the money between so we can go our separate ways?
If so, do I have to petition the court or something like that?
