ALABAMA.
A elderly mother passed away leaving her inheritance by will to her three grown children. During the probate process, one of the 3 passed away themselves. Will that child's surviving spouse be entitled to the inheritance?

No, the deceased child's surviving spouse is not entitled to directly inherit from the mother's probate estate.

The deceased child's probate estate is entitled to receive what the deceased child would have received. Depending upon the deceased child's testamentary arrangements, his surviving spouse might receive all or some of the inheritance from the mother's estate.
