My ex husband left me as beneficary on a life ins policy, according to our divorce it is now void. He had 3 years to change the beneficary but did not. His family wants to use the $ to payoff a loan that his mother made him. We have 2 minor children who were named in the will to receive everything, he did not list a contigent beneficiary on the policy. Will that $ go to the estate to payoff his debt or do the minor children receive the $.
