What is the name of your state? New Jersey

Scenerio: Mother lives in house with son, son's girlfriend and child. Mother dies, leaves house to daughter. Son living in house is on welfare and needs electric, gas, etc., in his g/f's name to get a reduced rate, also a letter stating he is renting the house to get rental assistance. If daughter, who is now the owner of the house allows utilities to be put in g/f's name and gives brother the letter as stated above, will that make it difficult for her to evict them, if in the future that becomes necessary. Not sure the the laws are in NJ on establishing residency. If the above is done, a lease would be in order, then eviction would be tough, especially when a child is involved.

It would probably be alright to go ahead and lease it now with an agreement, but the best course of action is for you to consult an attorney specializing in landlord/tenant/eviction law before you decide to rent it out to see if in fact it would be extraordinarily difficult or not to evict them at the appropriate time.
