Minor turning 18/filing for year's support


What is the name of your state (only U.S. law)? GA

I also posted this under the wills & estate planning forum ~

My ex-husband died 8-31-09. Our daughter will be 18 next week. Do I have to file a petition for a year's support before she turns 18, or do we have up to 2 years after his death to do so? Children over 18 are not allowed to petition for a year's support in GA. Essentially, she was < 18 when he died; does her turning 18 negate the 24 month provision?

There are issues with his current wife and I need to be able to save up the money to pay an attorney before I can file for a year's support for my daughter.
