What is the name of your state (only U.S. law)? ohio

My father in law passed away suddenly, he owns three properties, 2 with mortgages and one free and clear. He has no will, but several years ago had quit claim deeds made out signing all 3 over to my husband and I , my brother inlaw and his wife, and one other son. The deeds were never recorded. will the properties have to go thru Probate? My husband and his brothers are going to consult an attorney, but just trying to find out some answers before then.
