What if a person dies w/o a written will yet co-owns all properties with spouse? House is joint tenancy and a homestead filed for protection. Does it become living spouse property? What of credit card debt? If in the name of the deceased only and living spouse cannot afford payments -- what happens? Does spouse need to file at courthouse as executor of property tp protect their interests?
