How long does it take for a Personal Rep to be removed from an Estate due to conflict of interest and having the heirs sign consent waivers with the underlying motive of possible fraud provided there is sufficient evidence to support such allegation?

I'm not sure what you are trying to say either. However; if you suspect fraud by the personal rep., you should obtain a lawyer (if you have not already done so) to help you protect your interest in the estate. Are you currently in the process of trying to get the personal rep. removed?

The Personal Rep has contracted herself and her family to perform work for the estate. The heirs were never notified and no outside bids were obtained for the work. The heirs signed waivers claiming they were informed of what charges for this work was going to be levied against the Estate. The heirs were never informed any charges were to be levied. It would appear that the Pers Rep had an underlying motive to perform the work and levy the Estate to an enormous exaggerated sum. Hence the conflict of interest and possible fraud.

No one can tell you how long it is going to take since we don't know how many other probate cases are being heard in your county court. You need to be consulting a probate attorney now to find out what your next course of action should be.

To Senior Judge: The waiver and consent contains the following language: "Disclosure of the amount of compensation either paid to or to be paid to the personal representatives, attorneys, accountants, appraisers, or other agents employed by the personal representative." "The undesigned has actual knowledge of the amount and manner of determining the compensation in the above paragraph and has agreed to the amount and manner of determining that compensation and waive any objection of payment."

The heirs were not aware of any charges to be levied against the estate since it is a family affair so to speak.

So, why shouldn't anyone, including family members, be paid for doing work for the estate? :confused:

Have you & other heirs offered to do the work for free?

P.S. There's no fraud for paying people to do work for the estate.
