What is the name of your state (only U.S. law)? MI
Early last summer, my brother-in-law passed away, unexpectedly, his will named the oldest brother to be executor. There were 9 children in the family .. the oldest brother along with his son (whom he moved into the house) and a brother-in-law have since--knocked down two garages and one corn crib. (this is a farm)
changed an easement to a back property, won't let any of the sisters or brother go to the house, nor use anything on the property. Has locked up everything. He was going to let his son stay there for $1.oo. We are told that he can do anything he wants. Is this true?

Has anyone checked at the county courthouse probate court to see if the will was even probated? Of course not--he deliberately withheld it. Any of the heirs can file to get probate open so the judge can ask whoever has the will to produce it for probate court so that title can be officially transferred to whoever is entitled to inherit the house and the property, and then the heirs can decide whether they want to force a sale or rent the home out to PAYING tenants in a landlord-tenant signed agreement.

**A: no that is simply not true.

problems with personal rep. of estate

Yes the will was probated..but since then we had to go to mediation because some of us protested what the rep was doing--Since then, nothing has happened legally, but in the meantime he has had several buildings knocked down on the property, put in a new easement to a property on the back of the estate, belonging to members of the family, but not with the estate, this was against our wishes, as there was all ready an easement in force...this one takes off more property of the estate.... Now the latest--his son who is living in the house is going to different places like MSU and ASC telling them that he wants to farm the property and what crops should he put in. We don't want him doing anything to the property...What can we do????:mad:
