    Probate insurance reimursement estate

    What is the name of your state (only U.S. law)? California

    Are insurance reimbursements (monies) for damages to estate property an item/s that are Probate or None Probate? Specifically, I am probating in California there is real estate in the state of New Jersey. The dwelling on the property in New Jersey suffered a broken water pipe due to freezing temperatures. The interior of the structure requied complete gutting and requires a re-build. The insurance company has accepted and approved the claims in this matter. Checks will be issued to "The Estate of (decedent)".

    I am one of the representatives of the estate (Administrator). Can the insurance monies be used to complete the repairs to the estate without court permission?

    No, they cannot. The money goes to the beneficiaries. THEY get to decide how to spend it.
