What is the name of your state? Ohio.

Uncle dies without will. He has two homes on one parcel of property. No known liens on property. The estate has not gone through probate. Niece lives in second house rent free and has for several years (over 7 years). One of the relatives want the niece to leave and one wants her to stay (she could not afford to pay rent). Is the niece legally entitled to continue to stay in the house rent free-no lease or written agreement exists?

The next of kin needs to be consulting a probate attorney to get an intestate administration of this estate (meaning without a will), so that the legal heirs can be determined so they can decide whether to sell the home or start collecting rent from the niece.
