What is the name of your state? maryland
my brother died recently leaving behind a retirement fund with no beneficiaries.he was 3years married.he has two children who are not the childrren of the surviving spouse.how is the retirement fund going to be distributed?

How much money is in the retirement fund?

Sometimes preference is given to surviving spouses, but you need to be discussing this directly with the company that is holding the fund--they have rules and regulations about this which may or may not specifically agree with state law. They can tell you their opinion about how they plan to distribute this money, and then if necessary you can consult an attorney to see if the distribution is legal or not and whether you wish to file a challenge to it or not.
