should I open Probate


What is the name of your state? illinois
I am an only daughter, my father (not married) died after being manipulated on his death bed into signing a will he wouldn't of signed willingly. I at the moment only have an appointment with an Attorney to see about legal proceedings. I have checked and probate hasn't been opened as of this date. ( he died March 2, 2005) Would it be in my best interest to open probate myself?? I think the former step son had POA powers and I think he is trying to settle the estate without Probate.

Step son is no longer POA. It, the POA, expired when your father died. Only the Executor/Personal Representative of your father's estate can settle the estate. Also, you may want to have your attorney look into any fiduciary abuse of the POA.
