What is the name of your state (only U.S. law)? Mississippi

Father died with no will. Estate has not been to probate (yet). One of 5 children is living in Father's house against the will of the other 4 siblings. Either before or after probate, is there any way to legally have him evicted from the family property?

What does the will say about who gets the house? Executor will only get authority to evict (or buy out the share of whoever is living in the home) after the will is probated, by consulting a landlord/tenant eviction law attorney to find out the exact specific procedures that must be followed. Perhaps whoever lives in the home is under the mistaken impression that they can live there forever because they are part owner, but that is wrong.

He said there was no will. Get probate started. It's not likely ANYTHING will happen before that. The other siblings have no more right to say who gets to live in the house versus the guy living there at this point.
