What is the name of your state? California

There is a piece of property that is in my sisters name and my deceased mothers name. It is Tenants In Common on all paperwork. The probate judge has been delaying everything to determine if the property is part of the estate. Wouldn't half of the property belong to the estate? Why can't the judge make a decision?
