What is the name of your state? Florida. Unclaimed property in the name of my deceased father has been found in NJ. He died in Florida, leaving a wife, not my mother. His wife is now deceased. If she were the executrix of his will, do we, or her children, own rights to the unclaimed property?

The unclaimed property would be controlled by will or, if not specifically mentioned in the will (or by such devices as "ALL my property etc.,) then by the state's intestate provision.

If the unclaimed property is of sufficient value, it might be prudent to enlist the advice of a local probate attorney.

The unclaimed property office can probably tell you the order of/succession of heirs, but it would be smart to at least consult a probate attorney about this first to see what the legal outcome would be and exactly who is eligible to share in this money.
