What obligations does the estate lawyer have to the heirs/executors of the estate ? Our current lawyer seems to be working for the creditors of the estate rather than for the benefit of the heirs. Do we have any recourse for these actions ? Is this considered breach of contract or just being a poor lawyer ? The lawyer has pushed for the sale of the property so that the debts can be settled. We don't have a problem with that but there is only so much to go around. Shouldn't he be working to decrease/settle the debts ? Any advice would be appriciated ! Thanks ! Bethann

Sorry to burst your bubble, but creditors do have priority over heirs, because the debts must be paid first. Don't blame the lawyer just because the decedent didn't have enough assets to leave a substantial estate. Just be satisfied with whatever you can get, if anything.
