What is the name of your state? Philadelphia.
I am the Executrix of my grandmothers estate. It only consists of her house, as other family members have picked it clean. My problem is that my sister is living in the downstairs unit of the duplex and I am currently involved in a Landlord Tenant issue with her which she has used the system to the fullest. I got judgement but she appealed. So now the property has no insurance on it. No Fire, no property insurance, nothing. I applied to have it insured with just dwelling insurance, but to do that the inspectors need access to the property. However, my sister, stands outside like a crazy manic and won't allow anyone on the premises. I live in California, so it's not easy for me to always just hop a plane to go out and let them inspect. I did that before, and had to be escorted by the police to get into the property when the upstairs tenants moved out. Don't I have a legal responsibility to make sure the house is insured? Because we are in an appeal status with Landlord/Tenant, does that give her the right to make a stand, and refuse entrance to anyone. I need to get the property insured. What's my options? I'm so fed up with her.

What is the nature of your legal landlord/tenant issue with this sister? Are you trying to get her evicted or not?

Does the will give you permission to sell the home or are you required to rent it out?

We are in Landlord Tenant court because I want her out! She is paying nothing, supposedly as a previous verbal agreement with my grandmother. However, my grandmother has been gone one year and it's taking all this time with the courts to evict her. I have done every thing to the letter. In April I was given judgement to take possession, but she appealed, and was able get it free because she claimed she is very low income. However, I'm hoping when we get to the court of appeals they will award me possession and I can finally get her out. The Will named my Great Aunt as Executor, however she declined and since I was the ONLY person named in her Will I accepted the role of Executor/rix. And the house is mine, plain and simple. However while she is living there she doesn't allow me to do anything in or out without police protection. There has to be something I can do. This house is sitting there uninsured and she won't allow inspectors in so I can insure it.

The Landlord Tenant court gave me possession in April, she exercised her right to appeal and the court date was set 6 months later in October. I don't know what's going to happen then, but right now, she's keeping me, the legal Executrix of the Estate, from getting insurance on the property. Because I'm in California, is there nothing I can do? The property needs to be insured. Is this legal for her to do?
