IS it legal for the widow to try handle the deceased lawyer's files ?
such as calculating bills & farming out the cases etc?
I feel very uncomfortable this non lawyer is looking through my files & trying to determine what money she gets to keep:D
Is the fee agreement the same as a contract?
And is the purpose to protect Both parties Or just the one collecting the money?
the reason I am asking is b'cuz...if the client pays & the contract cannot be completed due to illness, death etc....
How Can the Trustee keep the money on the grounds...
lawyer dies..active clients were NOT notified,
clients had to find out by accident ,months after the fact.
Relative/trustee tells clients they can only have 10% refund,,,even cases that have little or no work done on case....
relative /trustee . ....months go by ... claims to not have...
a lawyer dies & the immediate relative acts as trustee. By trying to collect accounts.
the clients that paid up front ...can't get their money back. Because the relative/trustee wants to keep the advance payments..
the state bar can't do anything because the relative is not a lawyer.
How can...
When a lawyer logs hours & takes money from clients account , would there be something paper wise to reflect the hours logged?
If the lawyer has a log sheet saying they logged 20 hrs & takes money out of the escrow account......Wouldn't there be "drafts written", extensive notes etc...to back...
I used my credit card for a legal service...that would take a period of time about a year...
then, a few months later, the lawyer died...turns out they had not done work on the case.. and even IF they did do a some work it would have no value to anyone else...
Can I file a claim for service...
Cal,
lawyer died & money was already paid ...
no work done. trustee only wants to give a tiny refund this sounds unfair
is there a fiduciary duty?):D
what to do?
at first I thought it fair to accept a partial refund until I found no work done
