What is the name of your state? California. My brother was recently arrested again for writing bad checks. He has been arrested before but they want to put two strikes on him for this paticular one now. Is this legal to do?

If he has two prior felony convictions that qualify as strikes and he is being charged with felony bad check writing, it is legal.

Re the response to the 3 strikes

He has been in most of his adult life. He is 45 right now. I don't know when the 3 strikes law went into effect. But he has been in for grand theft auto, armed robbery, skipping the state while on parole, writing bad checks.
