detainer vs motion for speedy trialWhat is the name of your state (only U.S. law)? minnesota my daughter is incarcerated as of Qug 2009 she executed a probation violation sentence--she has like 5 felony forgery cases which she is also going to court for--she has had first appearances in all of them--when I tried to ask the public defenders to put in a motion for a speedy trial two of them said she needs to file a detainer from where she is--which is correct? If both are acceptable which is a better route to go? And is it possible for her to somehow request all charges run concurrent not consecutive? | The way you are asking your question is confusing. "executed violation" are you saying that she was already on probation and has violated it with the new forgery charges? Also you said she has to file a detainer from where she is. Are you saying that she got arrested on a violation warrant in another state? If so what state is the probation in and what state are the charges? Why a speedy trial request? Also how the charges are arranged will depend on a number of factors, you will have to give clearer information to get an even fairly accurate answer. |
