Sorry Carl, here is a new thread.

About 6 years ago, I was arrested and charged with a misdemeanor. I then had it expunged. I have been accepted for a job overseas and part of the process is that I must submit to an official FBI background check. It does not state what the reason for the FBI background check is CVDESIGN..... This involves me filling out some paperwork, getting fingerprinted, and sending it all in for the results.

The problem is that, on my application, It stated I must divulge any arrests, charges, or convictions, even arrests that never led to actual convictions. Basically, you have to list everything except minor traffic violations. On my application I said no, with my understanding being that my charge had been expunged 3 yrs ago, should not show up on any record and I could truly state that I had never been arrested, convicted, etc.

I got my FBI indentication report in the mail last week and it shows all the charges that were brought up against me. My one conviction and then at the bottom staes DISM 1203.4PC. So it looks like I was lying. It was an honest mistake but thinking about it in reflection, if I told them upfront and while they claim that a record doesn't necessarily disqualify you, the job is in another country where I know for a fact that any charge, would be looked upon almost certainly as a disqualifying detail.

Do I have anyway to clean slate on the FBI Indentifaction report?
Would you suggest me to contact a Expungement Lawyer?
Any Advice?

Expunging records is only removing them from public view, most law
enforcement and similar government agencies can still see them

Enspongement and FBI Record

I contacted the Department of Juctice and the FBI and got two different stories.

The department of Justice said I have to get my enspongement sealed to have the FBI remove it. They will sometimes do this for Pot (mary-j) cases, based on the new laws. Not sure they will do it for my charge.

i AM GOING TO GO TALK TO THE COURT WHERE THIS TOOK PLACE. Any other ideas?>

It doesn't matter if it's expunged and sealed, since most jobs requiring a federal check ask, HAVE YOU EVER BEEN ARRESTED, not just 'have you ever been convicted', you can't lie and say no just because it was sealed, you have to to tell the truth and put down 1. yes, 2. pot, 3. expunged.. be honest, it goes a long way. They will get this info anyway.

I've been through federal checks for work, and told the truth. I've never been turned down on any application.
