A friend of mine is thinking of filing a MAR. First off, he took a plea. He wants to file a MAR because he has good grounds to win, but his case will start over like he's just been arrested. He turned himself in and made a statement w/out a lawyer, which to me was a stupid move. (the statement part) His statement led to the capture and convictions of his 3 co-defendants. When counsel was received, he misrepresented him and this is the grounds for the MAR, but now the co-defendants are all convicted and he would not be any use to the DA. What should he do? File MAR or not.

Motion for Appropriate Relief. The purposes for filing a MAR include seeking a dismissal of all or some of the charges against you. You may also seek a new trial on some or all of the charges. Other relief to seek may include getting to plead guilty to a lesser-included charge other than the one for which you were convicted if the court that hears your MAR feels the evidence warrants such a result. A MAR could also seek resentencing.
