Florida Law. Sentencing Scoresheet:
On the Florida Sentencing Scoresheet there is line VIII which reads “Prior Serious Felony = 30 Points” Is there a definition of “Serious Felony” as applies to that or a list of Felonies to which that applies in either the Florida Statutes or the Administrative Code? Or is the term “Serious Felony” in this instance, arbitrary and if so who decides? Is it the Judge or the prosecutor?
Also there is Line VI. Which reads “Community Sanction before the court of sentencing 6 points x each successive violation OR New felony conviction = 12 points x each successive violation.” If a person had a previous case wherein that person were on probation and violated and received points under line VI would and that person were to commit a subsequent crime unrelated to the first, would the points on line VI in the previous case carry-over to the new sentencing worksheet or would this line only apply if the subsequent charge were a community sanction violation?
