inadequate counselWhat is the name of your state? I live in New York - but the case I'm talking about is in Oklahoma - A friend of mine plea bargained and pled guilty to a charge - I think he should've clearly pleaded diminished capacity. If this could be proven, now, and his pd never even mentioned the possibility could the original deal be overturned?? |

| Do they have a diminished capacity defense in Oklahoma? Even if they do, juries rarely buy it. If he did the crime, then accepting a plea bargain is a much better idea than relying on an acquittal based on a weak defense. |
