What is the name of your state (only U.S. law)?
Indiana Parole.
Situtation: friend was violated by parole in 10/06. Got pulled over in 05/08 on this warrant for parole violation. Picked a handgun possession charge when picked up on warrant. Friend was found guilty of possession. Faced the parole board and they dismissed original violation which was a #2 residence and employment and gave time back on sentence for dismissing this violation. Now leaving a #7 violation for catching a new case while on parole, doing a year on parole until flipping time to new sentence of gun case. The quesion is if they dismissed the original violation that would have taken him off of parole in 01/08, why is he currently serving time on parole? Shouldn't he have been dismissed from parole when they dismissed the original violation for lack of peliminary hearing due to untimely filing? I just need some direction do I need a lawyer or is this even a valid arguement? What is the name of your state (only U.S. law)?
