need help with my fathers wrongful 25 yr stacked sentence appealMassachusetts: My father was convicted of arson and insurance/mail fraud. with only circumstancial evidence to boot. he wasnt guity but thats beside the point now. hes now spent 21 months in federal prison and hes trying to appeal his sentence. he got screwed over big time with what i guess they call a stacked sentence and they sentenced him twice for the same thing. hes trying to appeal the second 10 year sentence but he said it didn't look good and I think his lawyers are boneheads anyways he really needs some real help!! He left behind 5 kids and 2 grandkids, also a wife. Were all heartbroken and shocked at how harsh his sentencing was. im not sure of the technical details, but the transcripts and other documents are being sent to me and i should have them soon. I'm totally desperate and i know that since the sentence was so unusually harsh there has to be a way to fight it. my dad also has lymphoma to make matters so much worse. | your father was found guilty of multiple serious felonies in federal court. federal sentences are serious. Federal sentences are often served consecutively (stacked) That does not mean he is serving the same sentence twice. Did you father have prior record? Also, 'circumstantial evidence' is used to convict. Circumstantial evidence as invalid to convict is a television myth.

| You know you're supposed to appeal in a timely fashion. Twenty-one months after the fact is probably too late to do anything barring some recent discovery of misconduct during the investigation/trial. He wasn't sentenced for the same thing. He was sentenced once for setting the building on fire (which is an illegal act) and once for trying to collect insurance money (which is an illegal act). Just because they were tried in the same trial doesn't make it one crime. By the way he could have gotten 20 years on each charge.
